September 2015 Various staff members are working to complete Courses I and II of the American Land Title Institute.
CFPB DELAYS START OF THE TILA RESPA INTERGRATED DISCLOSURE from August 1, 2015 until October 3, 2015, so we all
have 60 more days to become compliant, work out the bugs in software and determine the best course to take to have the residential
transactions take place with the least amount of delay and confusion.
BEGINNING AUGUST 1, 2015, the GFE HUD-1 Settlement Statement and the Truth-in-Lending Disclosure will be replaced on most
Single Family Residential 1 - 4 transactions. The lender will issue a "Loan Estimate" (LE) which will disclose information regarding the
loan which has been applied for by the borrower. At closing the Settlement Statement and Truth-in-Lending Disclosure will be merged
into one 5-page document entitled "Closing Statement" (CS). The Lender will be subject to new time delays and restrictions regarding
both the LE and the CS. The Lender will always prepare the LE, and depending on the Lender used by the borrower, either the Lender or
the Title Company will prepare the CS. Lenders who prepare the CS will require that all costs and payments to be disclosed on the CS
must be provided to them as much as two (2) weeks before the closing date. Changes in the APR, changes in loan terms such as a pre-
payment penalty, or other terms of the loan will require the Lender to re-disclose to the borrower resulting in a minimum 3-day
postponement of the closing. Lenders, real estate agents and brokers, and title companies are working together now to make sure the
changes which will begin August 1st do not upset the closing plans of buyers and sellers. You can learn more about these disclosures
